Nicolás Alviar currently acts as Managing Partner of Affirma Law, leading the firm's strategy and growth, as well as overseeing financial and commercial matters.
He began his professional career as an in-house counsel in a foreign Private Equity investment firm, which allowed him to acquire experience in the legal advice and representation of national and international companies.
In 2011 he founded, together with other partners, the firm AGT Abogados. There he held the position of financial and commercial director, in addition to practicing simultaneously as a litigation lawyer in corporate law, corporate, unfair competition, corporate criminal, arbitration and alternative dispute resolution mechanisms. After the arrival of new partners in 2014, he assumed the position of Managing Partner, focusing his efforts on expanding the client portfolio, seeking excellence in service and obtaining favorable results for the firm.
As of 2016, driven by the sustained growth of the firm, he assumed the position of Managing Partner, reinforcing the quality and efficiency of the legal services offered. His management has focused on the comprehensive management of legal matters and the coordination of the financial and commercial teams.
Currently, in addition to his role as Managing Partner of Affirma Legal, he advises individuals, corporations, boards of directors and shareholders in structuring legal strategies for sectors as diverse as pharmaceuticals, cosmetics, services, telecommunications, transportation, mining, medical and scientific cannabis, energy production, mass consumption, retail, food and beverages, textiles and foreign trade.
Mr. Alviar acts as attorney-in-fact for foreign investors in the incorporation of companies, business integrations, acquisitions, mergers, spin-offs, dissolutions, liquidations and asset disposals, as well as in foreign direct investment. Among the companies he has represented are EMEC, Zoho Corporation, LinScan, uHomie and Your Transportation Experts, among others.
In the field of unfair competition, he has led high impact litigation, including emblematic cases in the transportation sector (Taxis Libres Cotech vs. UBER, Transportes Armenia vs. Expreso Palmira), in the veterinary industry (Vetanco vs. Alimco SAS), in furniture and decoration (Orthobed SAS vs. Dormilife de Colombia SAS) and in the education sector (Fundación San Jorge vs. San George School Pereira SAS).
His practice in Corporate and Corporate Law has led him to represent clients such as Concentrix, Nivea, Nutrabiotics, Novasoft, Nikolucas, Crawford, Telnorm and Medical Green, among others. Likewise, in the litigation area he has defended the interests of Ecoanimal Health, Nivea, NewLab Nutrition, McCann World Group, Efitech and Balboa Bank & Trust, among others.
As a specialist in business law, he advises companies and sole traders in tax planning and tax litigation, both in administrative and judicial phases, protecting their interests before the tax authorities. His experience also includes the representation of foreign investors in mergers and acquisitions of medical cannabis companies, as well as the management of regulatory matters of this industry in Colombia, where he serves as general attorney of several companies.
In the area of medical and scientific cannabis, he represents as external consultant and general attorney-in-fact companies such as CBD Global and Diosa Verde SAS. Likewise, in intellectual property, he has managed around 700 trademark and patent proceedings before the Superintendence of Industry and Commerce (SIC), and before several international offices, applying the main treaties and protocols on intellectual property (PCT and Madrid Protocol).
As a criminal attorney, he acts as a defender and representative of the victims in the different stages of the criminal process, including the preliminary investigation before the prosecutor's office, preliminary hearings, indictment hearing, preparatory hearing, oral trial hearing, sentencing, appeals, special challenges and cassations.
His experience also extends to litigation and dispute resolution in corporate criminal law, labor law, corporate disputes, reorganization and insolvency, intellectual property and general civil and commercial disputes. He is widely recognized for his ability to propose innovative and effective solutions to the legal challenges faced by companies, having successfully advised close to 1000 companies and individuals, both nationally and internationally.
